T-SHIRT MACHINE™ values the users of our website www.tshirtmachine.co.za (the “Website”) and its services/products offered  (“the “Services”). Your privacy and trust are very important to us. We recognize that you may be concerned about our collection, use, and disclosure of the personally identifiable information (“Personal Information”) that we collect when you use the Website and/or the Services and, as such, we have created this Privacy Policy (“the Policy”) in order to protect your privacy and implement business practices that comply with the South African Protection of Personal Information Act, No. 4 of 2013 (“POPIA”), as amended, as well as any other Applicable Law.. DOES T-SHIRT MACHINE™ EVER MAKE CHANGES TO ITS PRIVACY POLICY?

Unless notice is required in terms of any Applicable Law, we (collectively referred to as “we”, “us” or “our” in this Policy) may change this Policy from time to time in line with any changes that the law or our internal organisational operations require, without prior notice. It is your responsibility to consider the Policy each time you utilise the Website and/or Services. You warrant further that none of the personal information you submit to us is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or obtained unlawfully and that needs to be corrected or deleted (“defective information”). You also accept that we cannot be held responsible for using defective information where it is not aware of the nature and extent of the defects in such information.

WHEN DOES T-SHIRT MACHINE™ COLLECT THIS INFORMATION?

We will process your personal information in the following circumstances:

  • When you engage with us on Social Media or in any other digital capacity;

HOW DOES T-SHIRT MACHINE™ USE MY INFORMATION?

For Merchants/Suppliers, we will not use the contact details of your customers to directly market or advertise the Services to them.
  6. to keep the website secure and prevent fraud as well as to improve our website or services by, for example, monitoring your browsing habits, or tracking your activities on the website; or

We are entitled to utilise or disclose your personal information if such use or disclosure is required in order to comply with any applicable law, order of court or legal process served on us, or to protect and defend our rights or property. In the event of a fraudulent online payment, we are entitled to disclose relevant personal information for criminal investigation purposes or in line with any other legal obligation for disclosure of the personal information which may be required of it.

WHAT ARE  T-SHIRT MACHINE’s™ LEGAL JUSTIFICATIONS FOR PROCESSING MY PERSONAL INFORMATION? 

Your use of the Website and/or any of the Services constitutes your explicit opt-in consent to our processing of your personal information. Further, we also rely on our contractual arrangements with you as the lawful basis on which we collect and process your personal information. HOW DOES T-SHIRT MACHINE™ PROTECT MY PERSONAL INFORMATION?

We will ensure that all of our employees, consultants, service providers and partners who have access to your personal information are bound by appropriate and legally binding confidentiality obligations and process your personal information at standards equal to or higher than ours in relation to your personal information.

We also reserve the right to retain on our records information you have requested be removed from our active databases for certain purposes, such as to resolve disputes and enforce our Terms of Business. Please also note that information submitted to us by you may in some instances never be completely removed from our databases due to technical and legal constraints. DOES T-SHIRT MACHINE™ COLLECT INFORMATION ABOUT ITS MERCHANTS CUSTOMERS?

In the course of providing the Services on our Merchant’s behalf, we may collect and process certain information about individuals at the direction of such Merchants (“Customer Data”). Customer Data has historically included information such as personal data relating to the end user of our Services, any personal data in the printing content (where applicable), personal data revealed during the use of any of the Services, including name, email address, phone number, shipping address, and other information about the Merchant’s customers.

If you are a customer of the Merchant (an end user of the Services), the Merchant is the data controller with regard to your personal data contained in Customer Data and should provide you the information on how your personal data is collected and processed when using our Services. Please read the Merchant’s privacy policy for further information. The Merchant is your contact for any questions you have about how it handles your personal data.

WHAT ABOUT CHILDREN’S PRIVACY?

We do not process the personal information of children when a data subject user is below the age of 18 (eighteen). Do not provide us with any such information. It is considered a material breach of this Policy.

DO WE PROVIDE LINKS TO OTHER WEBSITES?

The Website  and the Services available through the Website, may contain links to other third party websites. If you select a link to any third party website, you may be subject to such third party websites terms and conditions and/or other policies (including privacy policies), which are not under the control, nor responsibility, of us.

WHAT ABOUT MARKETING?
